1. Introduction
Welcome to OraSharedRegistry ("we," "our," or "us"). These Terms & Conditions ("Terms") oversee your interactions with our yacht rental offerings and website at orasharedregistry.sbs (the "Service") maintained by OraSharedRegistry.
By reserving a yacht or utilizing our Service, you consent to these Terms. Should you object to any section of these terms, you are not permitted to use the Service.
2. Service Overview
OraSharedRegistry supplies elite yacht charter offerings, encompassing:
- Rentals of yachts for daily use
- Evening sea voyages
- Business retreats
- Exclusive events
- Extended charters
All offerings are contingent upon availability and favorable weather. We hold the authority to adjust or cease offerings at our discretion.
3. Booking and Reservations
3.1 Booking Process
For a charter reservation, you must:
- Be a minimum of 18 years of age
- Supply valid and complete details
- Remit the necessary deposit as outlined in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A confirmed booking occurs only with payment receipt and our written acknowledgement. We reserve the prerogative to decline service to any individual as per our discretion.
3.3 Availability
Your desired charter times and dates are subject to the availability of the vessel and appropriate weather circumstances. We will attempt to accommodate your requests within reason.
4. Payment Terms
4.1 Pricing
All quotes are in € and cover applicable taxes unless specified differently. We reserve the right to amend pricing without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the full charter fee payable upon booking
- Remaining balance: To be paid 48 hours in advance of charter departure
- Extra fees (if any): Payable after the charter concludes
4.3 Payment Methods
We accept several payment methods including major credit cards, wire transfers, and verified checks. All payments are processed through secure encryption systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours before departure: Total refund minus transaction fees
- Between 24 to 72 hours prior to departure: A refund of half the price
- Less than 24 hours prior to departure: No refund issued
5.2 Weather Cancellations
In cases where our captain judges the weather as hazardous, we shall offer to:
- Reschedule the charter to another available date with no additional charges
- Issue a full refund if rescheduling is unfeasible
5.3 Mechanical Issues
If there are mechanical breakdowns with the allocated vessel, we will attempt to arrange a comparable substitute. In the absence of an alternative, a full reimbursement will be issued.
6. Safety and Conduct
6.1 Safety Requirements
Every passenger must:
- Heed all directives from the crew
- Don safety gear as needed
- Inform about any health conditions that could influence their safety
- Stay within assigned areas on the vessel
6.2 Prohibited Items
The ensuing items are forbidden onboard:
- Glass containers
- Illegal drugs
- Guns or other armaments
- Overindulgence of non-alcoholic drinks such as juice or soda
- Animals (unless pre-authorized)
6.3 Conduct
Passengers are expected to act respectfully. We maintain the right to end a charter prematurely without issuing a refund if passenger behavior endangers safety or impairs the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
Our financial responsibility is restricted to the sum paid for your charter. We're not accountable for:
- Bodily harm attributable to passenger recklessness
- Loss or spoilage of personal belongings
- Indirect or exemplary damages
- Delays originating from weather or situations out of our control
7.2 Insurance Coverage
We maintain extensive marine coverage for our vessels and operations. Charterers bear responsibility for their travel and personal insurance.
7.3 Assumption of Risk
By partaking in our charter services, you consent to the inherent hazards present in marine activities and accept the responsibility for your own protection and health.
8. Modifications and Itinerary Changes
If required due to operational necessities, safety or weather, we reserve the right to alter itineraries, courses, or schedules, endeavoring to provide similar alternatives.
9. Force Majeure
Events beyond our control that may lead to delays, cancellations, or needed changes in services include, but are not restricted to:
- Extreme weather events
- Natural disasters
- Regulatory commands
- Shut down of ports
- Vessel malfunctions
10. Privacy and Data Protection
As stated in our Privacy Policy, your personal data is processed. Use of our services implies your consent to data collection and usage in alignment with this policy.
11. Intellectual Property
The material on our website, such as text, visuals, logos, and images, are under copyright and trademark protection. Reproducing, distributing, or modifying content requires our explicit consent.
12. Governing Law
The laws of Germany govern these Terms. Any disputes will be adjudicated in the courts located in Hamburg, Germany.
13. Changes to Terms
We reserve the faculty to alter these Terms whenever deemed necessary. Updates will be publicized on our website, indicating the revision date. Service usage post-modifications indicates acceptance of the new terms.
